The bill applies to "special veterans," defined as persons who served in the active Armed Forces, who were (1) honorably discharged or released; (2) not convicted of various crimes, including voluntary manslaughter, murder, rape, or terrorism; and (3) not a child abuser or pedophile. Amends the definition of spouse for purposes of veterans' benefits to require the Department of Veterans Affairs (VA) to recognize a marriage based on the law of the state where the marriage occurred. When a marriage occurs outside a state, the VA shall recognize it if the marriage is lawful in the place where it occurs and could have been entered into under the laws of any state. The bill also amends the definitions of spouse and surviving spouse to remove the requirement that the spouse be of the opposite sex.

Updates the Department of Defense's Survivor Benefit Plan and how it operates in relation to other benefits. The plan currently provides a monthly annuity (based on a percentage of a service member's retirement pay) to an eligible beneficiary upon the death of the service member. Currently, if a surviving spouse is also entitled to dependency and indemnity compensation, the annuity paid under the plan will be reduced. The bill repeals certain provisions that require the offset of the plan annuity from amounts paid in dependency and indemnity compensation.
