Creating Zombie Property Remediation Act of 2021 [SB-42]
The purpose of this bill is to authorize a municipality to commence a proceeding in a court of competent jurisdiction, in the county in which the abandoned property is located, to compel a foreclosure to assist municipalities to be able to better address the “zombie properties” that are plaguing communities across the state.

Relating to paving contracts [HB-2113]
The purpose of this bill is to provide for the Commissioner of Highways to establish a pilot project to explore whether requiring paving contractors to also maintain for seven years the secondary roads they pave would produce better results than current practice. Annual reports to the Legislature’s Joint Committee on Government and Finance are required.

Relating to the Consumer Credit and Protection Act [HB-2130]
The purpose of this bill is to declare that the provisions of the Consumer Credit and Protection Act apply to general leases, landlords, tenants and residential rental fees a landlord may charge a general lease of residential real property. The West Virginia Supreme Court of Appeals held to the contrary in the case of Morrisey v Copper Beech Townhouses, 806 S.E. 2d 172 (W.Va. Oct. 12, 2017), citing, basically, the absence of specific legislative intent that this Act apply to general leases of residential real property.

Relating to sale of delinquent tax liens [HB-3062]
The purpose of this bill is to amend provisions relating to sale of delinquent tax liens; redemption; fees; and purchaser’s obligations and rights. The bill changes the time for redemption and time to set aside a deed; and reduces the time to redeem by persons with disabilities.

Relating to the state agency for surplus property [HB-3054]
The purpose of this bill is to permit the state agency for surplus property to require the state agency that is the current owner of property to remove all livery or other features identifying the property as state property prior to disposition; and permitting the state agency for surplus property to establish any form or requirement to ensure livery is removed.

Relating to compensation paid to landowners when interest in property taken by eminent domain is for a nongovernmental entity [HB-3046]
The purpose of this bill is to increase any award of just compensation to a property owner by to 200 percent of the fair market value eminent domain takings by nongovernment entities. The bill also provides for the compensation to landowners in the amount of 200 percent of the fair market value for takings by government entities that are transferred to nongovernment entities within ten years of the original taking.
