The purpose of this bill is to pay funds that are due in partition suits of oil and gas interests to persons whose names or locations are unknown, and who do not claim the funds for five years, to the Oil and Gas Reclamation Fund that is used to plug the thousands of abandoned oil and gas wells that no longer have responsible operators to plug them rather than have the funds escheat to the state.Â

The purpose of this bill is to clarify an unintended result as expressed in the holding of the Supreme Court of Appeals of West Virginia in the case of State of West Virginia ex rel. John D. Perdue v. Nationwide Life Insurance Company, No. 14-0100 (W. Va. June 16, 2015). The bill clarifies that the obligation to pay does not arise until after a claim is made with the insurer and due proof of death is received by the insurer. Relating to compensation paid to landowners when interest in property taken by eminent domain is for a nongovernmental entity [HB-3046]
The purpose of this bill is to increase any award of just compensation to a property owner by to 200 percent of the fair market value eminent domain takings by nongovernment entities. The bill also provides for the compensation to landowners in the amount of 200 percent of the fair market value for takings by government entities that are transferred to nongovernment entities within ten years of the original taking.
