The purpose of this bill is to delete language allowing a county commission to reimburse a mental health care facility for security services for the period of time a person is at the hospital prior to the determination of mental competence or incompetence. The bill further provides that the President of the West Virginia Sheriffs' Association, along with the Supreme Court of Appeals and the Secretary of the Department of Health and Human Resources shall develop and propose a statewide system for evaluation and adjudication of mental hygiene petitions. It requires the guardian to arrange for, and report on, social activities and visits with friends or family, and allows the court or Mental Hygiene Commissioner to intervene and order otherwise if the guardian's actions are not within the best interests of the protected person.
