- Penalties for theft of a firearm depend on the value of the stolen property:
- For property valued at $1,500 to less than $25,000: imprisonment up to 5 years, a fine up to $10,000, or both.
- For property valued at $25,000 to less than $100,000: imprisonment up to 10 years, a fine up to $15,000, or both.
- For property valued at $100,000 or more: imprisonment up to 20 years, a fine up to $25,000, or both.
Destruction of Firearms in Gun Buyback Programs
- A person or entity operating a gun buyback program must destroy any firearm that is traded in at the program, including all components and parts attached to the firearm.
- The destruction must be completed within 6 months of the firearm being surrendered in the program.
- The person or entity operating the program may contract with a law enforcement agency, organization, or business to fulfill the destruction requirement.
Revocation of Dealer's License and Felony Classification for Violations
- The Secretary of State Police will revoke a person's dealer's license if they violate the provisions of this Act.
- The trafficking of a regulated firearm is classified as a felony.
