Simple Explanation of Texas HB 875 (Workers' Compensation and Bid Bonding for Small Municipal Construction Projects)
This bill is about rules for small cities in Texas when they hire contractors for construction work.
What the Bill Does:
Who it applies to: Only cities with fewer than 20,000 people.
What kind of projects: Small construction projects at a single location that happen within 12 months.
Cost limit: The project cost must be less than 1% of the city’s most recent budget.
Key Changes:
For these small projects, the city does not have to require that contractors have workers' compensation insurance.
Also, the city does not have to require contractors to get a performance bond (a type of insurance to guarantee the work will be done).
The city cannot combine multiple projects to get over the 1% cost threshold—each project is considered separately.
Other Important Points:
The law only applies to contracts made on or after September 1, 2025.
This is meant to reduce paperwork and costs for small cities and small construction projects.
In short: Small Texas cities can skip requiring workers' compensation insurance and performance bonds for really small construction projects, starting in 2025.
