Federal Firefighters Fairness Act of 2009 [HB-948]
Federal Firefighters Fairness Act of 2009 - Provides that: (1) specified diseases, including heart disease, lung disease, tuberculosis, hepatatis, human immunodeficiency virus, and specified cancers, of federal employees in fire protection activities shall be presumed to be proximately caused by such employment; (2) the disability or death of such an employee due to such a disease shall be presumed to result from personal injury sustained while in the performance of duty; and (3) such presumptions may be rebutted by a preponderance of the evidence. To amend title 5, United States Code, to make unused sick leave creditable, for purposes of the Federal Employees' Retirement System, in the same manner as provided for under the Civil Service Retirement System. [HB-958]
Requires the total service of an employee who retires eligible for an annuity under the Federal Employees' Retirement System (FERS) (currently, an employee who retires on an immediate FERS annuity from the position of a registered nurse with the Veterans Health Administration), or who dies leaving a survivor entitled to benefits, to include the employee's days of unused sick leave for annuity computation purposes. Provides that those days will not be counted in determining average pay or annuity eligibility.
