Protecting Privacy in Purchases Act [HB-7450]
To prohibit payment card networks and covered entities from requiring the use of or assigning merchant category codes that distinguish a firearms retailer from general-merchandise retailer or sporting-goods retailer, and for other purposes.

Summary of the Bill: H.R. 7450 - Protecting Privacy in Purchases Act
The bill aims to prevent payment card networks and covered entities from forcing firearms retailers to use
specific merchant category codes that distinguish them from general-merchandise or sporting-goods retailers.
The bill also establishes enforcement mechanisms for violations of this provision.
Key Provisions:
The bill contains the following key provisions:
A payment card network, which facilitates credit card and debit card transactions, cannot require firearms
retailers to use specific merchant category codes distinguishing them from other retailers.
Covered entities, such as entities that process credit card transactions, cannot assign firearms retailers
merchant category codes that distinguish them from other retailers.
The Attorney General is responsible for enforcing this provision and establishing a process for individuals,
including firearms retailers, to submit complaints about violations of this provision.
If a payment card network or covered entity violates this provision, the Attorney General can send them
written notice to remedy the violation within 30 days. If they fail to do so, the Attorney General may
bring an action in federal court to stop their violating behavior.
The bill preempts any state or local laws that regulate merchant category codes for firearms retailers.
The Attorney General must submit an annual report to Congress that includes information about the number
of investigations undertaken, case summaries, and data and analysis regarding the effectiveness of the
bill.
Definitions:
The bill includes the following definitions:
Ammunition: Refers to the items defined in section 921(a)(17)(A) of title 18, United States
Code.
Covered Entity: Any entity that establishes a relationship with a merchant for credit,
debit, or prepaid transactions, or establishes a relationship with an entity that has a relationship with
a merchant for such transactions.
Firearm: Items defined in section 921(a)(3), (5), (7), (16), (29), (30) of title 18, United
States Code.
Firearms Retailer: A person or entity lawfully engaged in selling or trading firearms or
ammunition for firearms.
Merchant Category Code: A code issued by the International Organization for Standardization
that enables the classification of merchants into specific categories based on their type of business, trade,
or services.
Payment Card Network: An entity or its licensed member, processor, or agent that provides
services, infrastructure, software, or hardware used to authorize, clear, and settle credit card and debit card
transactions.
