This Bill repeals mandatory minimum sentences in Title 16 relating to violations of our drug laws, returning to our State’s outstanding judiciary the discretion to pronounce sentences appropriate to the cases and individuals before them. An Act To Amend Title 29 Of The Delaware Code Relating To The Assessment Of A Prosecution Fee. [HB-175]
This legislation recognizes that one of the consequences of crime is that employees of the Department of Justice are required to prosecute the offenses. When a defendant is held to be responsible for an offense, requiring the defendant to make a payment acknowledging the cost to the State serves the purposes of the criminal justice system. In addition, the courts are given discretion to reduce or waive the fee when the defendant timely acknowledges responsibility for an offense. Such timely acknowledgement reduces the actual costs to the Department

An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-176]
This bill increases the minimum fine for the first offense of Graffiti from “$500” to “$1000” and increases the hours of community service from “200” to “250”. The bill also increases the minimum fine for the second or subsequent offense of graffiti to “$2000” and increases the hours of community services to “500” hours.

An Act To Amend Title 25 Of The Delaware Code Relating To The Unit Property Act. [HB-183]
Section 1 amends 2201 to provide a reference to the appropriate section of the Delaware Uniform Common Interest Ownership Act, 25 Del. C. 88-101, et seq., (“DUCIOA”) that serves as a roadmap for those provisions of DUCIOA that apply to existing condominiums that were formed under the Unit Property Act. Section 2 amends 2202(18) to substitute as the definition of a “reserve study” under the Unit Property Act the current definition from DUCIOA for a reserve study, so that the two acts are consistent. This bill requires all independent unlicensed clinical social work practitioners in Delaware to obtain a license for the continued practice of social work. This bill does not apply to clinical social work practitioners whose sole source of employment or income is through an agency of the state or federal government.
