Car theft was the primary impetus behind state codes prohibiting a motor vehicle owner to leave a car unattended with the keys in the ignition; a common habit to warm-up the vehicle during colder months. From 2013 to 2015, a total of 206 cars were stolen in Delaware due to the owner leaving the keys in the car while unattended; of these, 12 went unrecovered. Subchapter III, Chapter 68, Title 7 of the Delaware Code (Subchapter III) was originally enacted in 1982. In 1996, President Clinton signed the Bill Emerson Good Samaritan Food Donation Act, 42 U.S.C. § 1791 (Bill Emerson Act). The Bill Emerson Act preempts Subchapter III to the extent of any conflict, known as partial preemption.

An Act To Amend Title 7 Of The Delaware Code Relating To Funds Of The Regional Greenhouse Gas Initiative. [HB-273]
This Act will direct the first $8 million in auction proceeds received from the sale of emission allowances through the regional Greenhouse Gas Initiative and CO2 Emission Trading Program to be directed to the General Fund for the fiscal year 2018. The balance of the funds will be directed to the Secretary of the Department of Natural Resources and Environmental Control to be directed for the public benefit in accordance with the goals and purposes of this initiative.
