This Act expands the scope of Delaware’s public accommodations lodging tax to include temporary and seasonal rentals for less than 5 months. It also provides for a reduction in the amount of the lodging tax imposed to take into consideration any existing tax imposed by a county or municipality as of the effective date of the Act’s provisions. Finally, the act requires owners of rental unit to annually obtain a Rental Unit License from the Department of Finance at a cost of $50.00.

An Act To Amend Title 18 Of The Delaware Code Relating To Developmental Screening Of Infants And Toddlers. [HB-199]
This Act requires that private health insurers in Delaware cover the developmental screenings for infants and toddlers that are recommended by the American Academy of Pediatrics and the Delaware Early Childhood Council. Such screenings are already covered for children in the state’s Medicaid program. The estimated cost to policyholders of covering these screenings is three cents per member per month.

An Act To Amend Chapter 60, Title 7 Of The Delaware Code Relating To Beverage Containers [HB-201]
This act repeals the “bottle bill”, Subchapter III, Chapter 60 of Title 7 of the Delaware Code, in its entirety, effective September 1, 2010. The Act further requires that distributors provide dealers with notice of the effective date of the repeal and a public notice to be posted in retail locations from January 1, 2010, through September 30, 2010. On December 22, 2008, Delaware City Fire Company paramedic Michelle Smith was tragically killed in the line of duty by a reckless driver. Under current Delaware law, a person who recklessly causes the death of an on-duty law enforcement officer, corrections employee or fire fighter is guilty of murder in the first degree and eligible for capital punishment. This Act, named in Michelle’s honor, adds paramedics, EMTs, Fire Marshalls and fire police officers to same statutes, ensuring that any person who recklessly kills one of Delaware’s first responders

This bill increases the penalties for the crime of “sex offender unlawful sexual conduct against a child” when the victim is under the age of eighteen and has a cognitive disability. Additionally, the bill amends the definition of “without consent” as it applies to sex crimes to help protect individuals with cognitive disabilities.

An Act To Amend Title 24 Of The Delaware Code Relating To Architecture. [HB-227]
This Act permits business entities to offer architectural services through professionals registered with the Board after obtaining a certificate of authorization. The requirements of the Act are similar to those in existence regarding the practices of accountancy and landscape architecture. The Act also increases the civil penalties that may be imposed by the Board from $2,500 to $5,000 for first offense and from $5,000 to $10,000 for subsequent offenses.

An Act To Amend Title 6 Of The Delaware Code Relating To Debt Management Services. [HB-232]
This Bill clarifies that the Debt Management Services Act is intended to regulate providers who negotiate terms or concessions related to an individual’s unsecured debt. Businesses offering to negotiate modification of mortgage loans on behalf of individuals with homes in foreclosure are required to comply with provisions of the “Mortgage Rescue Fraud Protection Act” in 6 Del. C. Chapter 24B.
