This Act permits the Superior Court to temporarily assign duties to a retired Commissioner at the designation of the President Judge with the approval of the Chief Justice of the Supreme Court. A retired Commissioner must have been in good standing at the time of his or her retirement, agree to the assignment, and not be involved or employed in any position that would create a conflict, including the private practice of law, holding any state office, or being employed by the State in any capacity. An Act To Amend Title 15 Of The Delaware Code Relating To Elections. [SB-242]
This Act eliminates the financial bar to voter registration and makes technical changes to bring the chapter into conformity with 2, article V of the Constitution of this State, which no longer requires a 5 year waiting period before a person convicted of a non-disqualifying felony may register to vote. An Act To Amend Title 15 Of The Delaware Code Relating To Persons Permitted In Voting Room. [SB-255]
In implementation of federal law, 4943 of the Election Code was amended in 2012 to allow voters who require assistance to vote by reason of blindness, disability, or inability to read or write to be given assistance by a person of the voter’s choice. However, other sections of the Code were not updated to reflect the change which could result in confusion or criminal prosecution. This bill is a housekeeping measure to conform inconsistent provisions in the Election Code.

An Act To Amend Title 10 Of The Delaware Code Relating To The Family Court Of The State Of Delaware. [SB-55]
This Bill extends the number of days for an emergency ex parte order from 10 days to 15 days. Currently, an ex parte order is issued and a full hearing is scheduled within 10 days. This can be insufficient time to effectuate service of the order and petition on the respondent. If respondent has not been served, the hearing is rescheduled and the petitioner must return to court the following week. Scheduling the hearings within 15 days will allow more time for service on the respondent, and afford more time for the parties to prepare for the hearing.

This Act serves to permit those incumbents occupying upper-level management positions in the Justice of the Peace Court to elect to remain in classified service or move to exempt service. This change ensures that incumbent management employees have the choice of exempt status, which, in some instances, will be offered to their newly-hired subordinates.
