An Act To Amend Title 4 Of The Delaware Code Relating To Alcoholic Beverages And Gathering Licenses. [HB-105]
This Act would allow, but not require, retailers and importers (a.k.a. wholesalers) to donate alcoholic beverages to not-for-profit organizations if such organization has obtained a “gathering license” from the Commissioner. This Bill would also permit a gathering licensee to sell alcohol for consumption off the premises where the alcohol was sold so long as such sale is by means of a raffle or auction, live or silent, and the total amount of alcohol sold does not exceed 10 gallons in a single day. An Act To Amend Title 26 Of The Delaware Code Relating To Rate Schedules And Rate Classifications. [HB-121]
Delaware has two regulatory schemes for competitive local exchange carriers providing telecommunication services in Delaware. Under Section 707 of Title 26, a local exchange carrier cannot charge a switched access rate higher than that charged by the largest service provider in the State. Currently, Section 301 of Title 26 does not contain this same rate ceiling. This legislation provides parity between the two regulatory processes so that regardless of the regulatory scheme governing the carrier, the switched access rates of all Delaware carriers

An Act To Amend Titles 7 And 30 Of The Delaware Code Relating To Gross Receipts Taxes. [HB-127]
This Act provides a gross receipts tax cut to all taxpayers by: (a) cutting rates across-the-board by 3% and (b) increasing by 25% the monthly and quarterly exclusion levels for all business categories. It clarifies the rate reduction scheduled to take effect in 2014 and it restores full funding for the Hazardous Substance Clean-up program two-years earlier than originally planned. An Act To Amend Titles 29 And 30 Of The Delaware Code Relating To Public Utility Tax Rates And The Use Of The Proceeds Thereof. [HB-129]
This Act reduces the general public utility tax rate on electricity and gas from 5.00% to 4.25%. The Act also reduces the rate on electricity and gas distributed to manufacturers, food processors and other agribusinesses from 2.35% to 2.00%. The Act also transfers the first $5 million in proceeds generated by the public utility tax to the new Energy Efficiency Investment Fund, which will be used to finance energy efficiency projects that will reduce overall energy use and create jobs.
