Many Homeowners’ Associations are faced with the frustrating situation of attempting to collect assessments from delinquent homeowners while facing expensive legal costs to enforce their rights. In addition, if the Homeowners’ Associations fail to take prompt action, they may be waiving any right to collect unpaid assessments. Beginning with all assessments made after January 1, 2017, the changes in this bill will provide for an increased chance at collecting unpaid assessments. An Act To Amend Title 13 Of The Delaware Code Relating To Child Support. [HB-294]
Currently in the State of Delaware there are high arrearages in child support owed and past due. In many circumstances persons’ who are owing support have received monetary awards in the form of a court settlement, judgment or under a workers compensation claim. This Bill requires the Division of Child Support Enforcement to maintain an active list of persons who are in arrears of their child support duties.
