An Act Concurring In A Proposed Amendment To Article Viii Of The Delaware Constitution Relating To The Transportation Trust Fund. [SB-20]
This Act is the second leg of a constitutional amendment that will limit the ability of the State to appropriate Transportation Trust Fund moneys to a purpose other than (1) capital expenditures on the public transportation system, including the road system, grants and allocations for investments in transportation, the transit system, and the support systems for public transportation; (2) payment of the interest and principal on all bonds issued before or after the effective date of this Act and secured by moneys in the Transportation Trust Fund;

Far too many Delawareans have been personally affected by addiction and substance use disorder and have experienced the tragedy of watching loved ones suffer from this chronic disease. Nearly 2,000 individuals in Delaware suffered a non-fatal overdose in 2017, but data suggest that many of these individuals continued to be prescribed opioid pain medications or did not receive substance use disorder treatment.

This Act creates Pay for Success contracts. A Pay for Success contract is an agreement between a State agency and either a program intermediary or an investor under which an investor will provide upfront capital to fund a service, program, or economic development initiative. The State agency agrees to repay the program intermediary or investor if the service, program, or economic development initiative meets the performance measures and outcomes agreed to in the contract.
