An Act To Amend Title 16 Of The Delaware Code Relating To The Delaware Healthy Children Program. [HB-139]
This Bill extends Delaware’s Childrens’ Health Insurance Program (CHIP) to include reduced-cost health insurance coverage for children of families with personal incomes above 200% of the Federal Poverty Level. However, a cost-sharing program is to be implemented under CHIP whereby payments, as determined by DHSS, must be paid on behalf of the child for such care; notwithstanding the above, the cost-sharing provision of the bill is designed to have the new program impose no cost whatsoever on the State unless funds are specifically appropriated for (continued...)

An Act To Amend Title 29 Of The Delaware Code Relating To Prevailing Wage Requirements. [HB-145]
This Bill corrects inconsistencies with respect to including the type of construction as a qualifier for a particular trade’s prevailing wage rate, and provides for a method to establish wage rates at the end of any five year term. It also provides that if the rate is not determined to be the collective bargaining rate, then the rate determined by the annual survey shall be the rate for a five year period, subject to raises tied directly into the prior year’s pay raise for State employees. An Act To Amend Title 10 Of The Delaware Code Relating To Pleadings And Practice. [HB-155]
This bill ensures that for a period of two (2) years beginning July 1, 2009, victims of childhood sexual assaults by adult public sector employees may bring actions. Additionally, in the future sovereign immunity is waived as to the State and its political subdivisions, including school districts, for sexual abuse of a minor by an adult.

An Act To Amend Title 29 Of The Delaware Code Relating To Powers, Duties, And Functions Of The Secretary Of The Department Of Health And Social Services. [HB-159]

An Act To Amend Title 16 Of The Delaware Code Relating To Drug Offenses. [HB-168]
This Bill repeals mandatory minimum sentences in Title 16 relating to violations of our drug laws, returning to our State’s outstanding judiciary the discretion to pronounce sentences appropriate to the cases and individuals before them. Delaware’s sentencing guidelines and Truth-in-Sentencing Law will remain in force, helping to guide judges in their decisions and ensuring offenders’ completion of their sentences. This bill requires that a person elected to a state office or appointed to fill a vacancy in an elective state office, or who has filed as a candidate for an elective state office disclose the name and address of every nonprofit organization, civic association, community association, foundation, maintenance organization, or trade group incorporated in the State or having activities in the State, or both, of which the person is a council member or board member.

An Act To Amend Title 29 Of The Delaware Code Relating To The Assessment Of A Prosecution Fee. [HB-175]
This legislation recognizes that one of the consequences of crime is that employees of the Department of Justice are required to prosecute the offenses. When a defendant is held to be responsible for an offense, requiring the defendant to make a payment acknowledging the cost to the State serves the purposes of the criminal justice system. In addition, the courts are given discretion to reduce or waive the fee when the defendant timely acknowledges responsibility for an offense. An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-176]
This bill increases the minimum fine for the first offense of Graffiti from “$500” to “$1000” and increases the hours of community service from “200” to “250”.
