This Act recognizes a military service member’s executed Record of Emergency Data Form (DD Form 93) as a valid declaration instrument governing the disposition of the service member’s last remains in the event of death. Pursuant to Federal law (Section 564 of Public Law 109-163), military service members must execute a DD Form 93 designating a person authorized to direct disposition of their remains in the event of death. Service members must update the form annually and prior to any deployment

This bill would require courts, administrative tribunals, school districts, and schools to use the definition of “free and appropriate education” with respect to disabled children that has been enumerated for this region of the country by the United States Third Circuit Court of Appeals in Ridgewood Board of Education v. N.E., 172 F.3d 238 (3d. Cir. 1999).

An Act To Amend Title 16 Of The Delaware Code Relating To Immunity For Donations To Volunteer Fire Departments. [HB-330]
This Act is intended to encourage governmental and/or private donations to volunteer fire departments by ensuring that any entity that donates “qualified fire control or rescue equipment” to the volunteer fire department shall not be liable for civil damages for personal injuries, property damage or loss, or death caused by the equipment after the donation unless such person’s action or omission causing the harm constituted gross negligence or intentional conduct.

This Act enhances the Family Court’s ability to protect victims of domestic violence and abuse by authorizing the Family Court to enter the no contact provisions of protection from abuse orders for up to 2 years in every case and, where aggravating circumstances exist, authorizing the Family Court to order no contact for as long as it deems necessary to prevent further abuse, including the entry of a permanent order.

This Act enables Delaware’s public libraries to respond to expanding demand for and use of wireless and mobile technologies while clarifying that the use of such devices is subject to the Delaware Children’s Internet Protection Act. An Act To Amend Title 14 Of The Delaware Code Relating To Parental Involvement In Schools. [HB-350]
Section 1 of this bill would require schools to seek the signature from each parent of a parent/school compact at the beginning of each school year, reflecting an updated Parents’ Declaration of Responsibilities to be prepared by the State and parent organizations. Existing law encourages, but does not require, that parents be asked to sign such a compact. This Act creates the Delaware Aging and Disability Resource Center within the Division of Services for Aging and Adults with Physical Disabilities of the Department of Health and Social Services, replacing the current Elder Care Information and Support System for Delaware Families. The Aging and Disability Resource Center will provide support for the elderly and adults with physical disabilities by combining existing Alzheimer’s specific information into the program and supporting future Federal grant applications for Aging and Disability Resource
