An Act To Amend Titles 3, 11 And 29 Of The Delaware Code Relating To The Operation Of Table Games By The Delaware Lottery, The Creation Of A Division Of Gaming Enforcement Within The Department Of Safety And Homeland Security, Licensing Of Video Lottery Agent Personnel And Lottery And Agent Vendors, Prohibition On Gaming By Certain Persons, The Creation Of A Lottery Commission, And The Number Of Harness Racing Days. This bill authorizes the introduction and operation of table games by the Delaware Lottery at licensed video lottery agents. Like the video lottery, the table games would be offered on the premises of Delaware's video lottery agents. The Delaware Lottery would determine which table games would be played and establish regulations for the effective management of the games. Proceeds from the operation of the Delaware Lottery would be paid to the Delaware Lottery, which would keep a portion of those proceeds to cover its administrative expenses and (continued...)

By way of this Act, to the extent there is no conflict with the provisions of this subchapter, the powers, remedies and penalties provided for in Title 6, Chapter 25, subchapters I, II, III, VIII, and XI; Title 25, Chapters 51, 53, 55, and 57; and Title 29, Chapter 25, subchapter II are hereby incorporated and made applicable to Title 25, Chapter 70, subchapter I. An Act To Amend Titles 25 And 29 Of The Delaware Code Relating To Manufactured Home Communities And Consumer Protection Advisory Councils. [HB-313]
This bill amends existing section 7001A, Title 25 of the Delaware Code by making several revisions to the existing alternative dispute resolution methods (“ADR”) that are to be followed by the parties. An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-322]
This Act corrects a loop-hole in Delaware’s felony resisting arrest statute identified by the Delaware Supreme Court’s recent opinion in Watson v. State, No. 335, 2009 (January 6, 2010). In Watson, two probation and parole officers were injured by a defendant while trying to make an arrest for a probation violation. On appeal, the Delaware Supreme Court reversed Watson’s convictions for the felony offense of resisting arrest by force or violence under 1257(a) because the statute, by its express terms, only applies to arrests by police officers. Consistent with Delaware’s Child Victim’s Act, this Act clarifies that civil actions based on sexual abuse of a patient by a healthcare provider may be filed at any time after the commission of the abuse. This Act also creates a 2-year “look-back” provision in cases of abuse which was unknown and could not reasonably have been discovered by the patient.

An Act To Amend Title 16 Of The Delaware Code Relating To Immunity For Donations To Volunteer Fire Departments. [HB-330]
This Act is intended to encourage governmental and/or private donations to volunteer fire departments by ensuring that any entity that donates “qualified fire control or rescue equipment” to the volunteer fire department shall not be liable for civil damages for personal injuries, property damage or loss, or death caused by the equipment after the donation unless such person’s action or omission causing the harm constituted gross negligence or intentional conduct.
