An Act To Amend Title 9 And Title 29 Of The Delaware Code Relating To Government Records Management. [HB-262]
This Act increases the current State surcharge on each document or paper recorded or filed with the county recorders from $6 to $30. Additional proceeds of $24 per recordation or filing will supplement the Government Records Management Improvement Fund, which is renamed by this Act as the Delaware Cultural Access Fund. Fund fees retained by the State will be used to promote, preserve and protect Delaware’s cultural assets. Fees for the Government Records Management Improvement Fund have not been increased since 1991.

An Act To Amend Title 30 Of The Delaware Code Relating To Taxes On Personal Income. [HB-264]
This Act will increase the personal income tax rates from 5.55% to 5.95% on taxable income ranging from $50,000 to $60,000; from 5.95% to 6.95% on taxable income ranging from $60,000 to $150,000; and from 5.95% to 7.45% on taxable income in excess of $150,000.

An Act To Amend Title 30 Of The Delaware Code Relating To The Estate Tax. [HB-265]
This Act reinstates Delaware’s estate tax. Prior to 2002, the Internal Revenue Code allowed states to effectively share estate tax revenue with the federal government. From 2002 to 2005, the states’ share of this arrangement was phased-out. Under this Act, Delaware’s estate tax will be calculated using the rate schedule for state tax credits available under federal law in 2001. This Act recognizes other updates to federal estate tax law that have occurred since 2001.

An Act To Amend Title 30 Of The Delaware Code Relating To Gross Receipts Taxes. [HB-266]
This Act increases certain General Fund business and occupational gross receipts tax rates. Sections 1 through 16 of the Act set forth the specific gross receipts tax rate increases made by the Act. Section 17 of the Act eliminates a sunset provision that would have automatically repealed the gross receipts tax rate increases that were enacted in 2008. Section 18 of the Act is a severance provision. An Act To Amend Chapter 5, Title 30 Of The Delaware Code Relating To Procedure, Administration And Enforcement. [HB-268]
Section 1 is intended to establish a Voluntary Compliance Initiative for eligible taxes administered by the Division of Revenue for a period running from September 1, 2009 through October 30, 2009. Any taxpayer who has a current outstanding liability for tax periods before January 1, 2009 and makes payment during the Initiative period or enters into a payment plan and makes payment before June 30, 2010 will have penalty and interest for late filing the return waived. An Act To Amend Title 6 Of The Delaware Code Relating To Standard Weights And Measures. [HB-273]
The legislation establishes the Department of Agriculture’s authority to charge annual fees for the registration of weighing and measuring devices to be used for commercial purposes in the State of Delaware. The fees set forth in this legislation are designed to fund all of the activities of Delaware’s Weights and Measures. It also calls for the creation of a special fund to be administered by the Weights and Measures section, the proceeds of which will not for any reason lapse in favor of the State’s General Fund.
