An Act To Amend Titles 11, 16, 17 And 21 Of The Delaware Code Relating To Criminal Mischief, Graffiti, And Other Injury To A Scenic And Historical Highway Or A Scenic Byway. [HB-276]
This bill adds a mandatory $500 penalty to criminal and/or civil charges of injuring, damaging, littering, or applying graffiti to or along a scenic and historical highway or a scenic byway, as defined in 17 Del.C. 101(a)(9), as follows: 101(a)(9) A “Scenic and Historic Highway” or “Scenic Byway” is a transportation route which is adjacent to or runs along or next to an area that has particular intrinsic scenic, historic, recreational, cultural or archaeology qualities for which such transportation route is managed in order to protect such characteristics (continued...)

An Act To Amend Title 10 Of The Delaware Code Relating To Reporting Financial Exploitation Of The Elderly And Infirm. [HB-302]
This bill is intended to encourage the reporting of suspected financial exploitation of the elderly and infirm adults by providing immunity from criminal and civil liability for making such reports. Under the bill, anyone who makes a good faith report to law enforcement authorities of such suspected activity is immune from criminal and civil liability for making that report. An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-304]
This bill provides that a person who stands in a position of trust, authority or supervision over a child who is at least 16 years old but not yet 18 years old and intentionally engages in sexual intercourse or sexual penetration with such child or an invitee or designee of such person shall have committed the offense of Rape in the 3rd degree which is a class B felony. This offense is currently Rape in the 4th degree which is a class C felony.

An Act To Amend Title 18 Relating To Captive Insurance Companies. [HB-314]
This legislation amends chapter 69 of title 18 of the Delaware Code by adding two types of captive insurance companies to those that can currently be licensed in Delaware. The two new forms of captive insurance companies are “agency captive insurance companies” and “branch captive insurance companies.” Agency captive insurance companies are reinsurance companies owned by insurance agents or brokers who underwrite and place insurance policies for conventional insurance companies. An Act To Amend Title 21 Of The Delaware Code Relating To Driving A Vehicle While Under The Influence. [HB-315]
This Act protects the community by increasing the level of services and supervision applicable to those individuals convicted of Driving Under the Influence. The Act protects residents of the State of Delaware by requiring mandatory use of approved ignition interlock devices and participation in victim’s interaction sessions for first-time offenders. Similarly, this Act requires mandatory in-patient substance abuse treatment, Continuous Remote Alcohol Monitoring, and ongoing substance abuse testing for second-time offenders.

An Act To Amend Title 14 Of The Delaware Code Relating To Exceptional Persons. [HB-328]
This bill would require courts, administrative tribunals, school districts, and schools to use the definition of “free and appropriate education” with respect to disabled children that has been enumerated for this region of the country by the United States Third Circuit Court of Appeals in Ridgewood Board of Education v.
