An Act To Amend Title 14 Of The Delaware Code Relating To The Education Of Students With Disabilities [SB-229]
Section 1 of the Act would permit the state’s most severely cognitively disabled students, with the consent of their parents, IEP teams, and school districts, to receive special exemptions from taking either of the state’s standardized assessments. The academic progress of those students would still be measured in order to ensure that they are being challenged and provided meaningful instruction. Sections 2 and 3 of the Act attempt to ensure that evidence-based interventions are provided for young students who have dyslexia and related disabilities,

An Act To Amend Title 7 Of The Delaware Code Relating To Environmental Control. [SB-232]
This bill defines “crusher” and requires that any crusher have a mandatory set back from residences and residential communities. A crusher is often used to reduce the size of waste concrete for disposal or recycling. The process of crushing concrete results in the release of air contaminants, which can include toxic dust, produces contaminants that can pollute the water supply, and can cause noise and vibrations that negatively impact the well-being of the general public. An Act To Amend Title 16 Of The Delaware Code Relating To The Volunteer Firemen’s Pension Plan. [SB-240]
This bill clarifies that a participating volunteer fire company or ladies auxiliary in the Delaware Volunteer Firemen’s Pension Plan has the ability to withdraw from the plan. As part of that withdrawal process the company or auxiliary would pay a withdrawal liability payment that would be used to pay the retirement benefits of their member’s accrued benefits and ensure the actuarial soundness of the Fund for the remaining Employers.

An Act To Amend Titles 7, 11, And 23 Of The Delaware Code Relating To Environmental Violations. [SB-258]
This legislation declassifies a number of minor violations associated with wildlife, hunting, fishing and boating by changing them from Class C and Class D environmental misdemeanors to environmental violations. These environmental violations will not be reported on criminal history records kept by The Delaware Criminal Justice Information System (DELJIS); however DNREC is authorized to retain records on environmental violations to ensure that second offenses and higher penalties are pursued when appropriate.
