An Act To Amend Title 24 Of The Delaware Code Relating To Pawnbrokers, Secondhand Dealers And Scrap Metal Processors. [SB-194]
This Bill seeks to do four things. First, it brings the reporting requirements for pawnbrokers and secondhand dealers in line with those of the scrap metal processors. Next, it extends the deadline for reporting for scrap metal processors to close of business the next day. Third, it makes a clear exemption for businesses that take in trade ins as a substantial part of its business. Finally, it adds a cease and desist provision for those operating without a license.

An Act To Amend Title 7 Of The Delaware Code Relating To The Delaware Hazardous Substance Cleanup Act. [SB-198]
This legislation updates lender liability under the Hazardous Substances Cleanup Act by amending and adding definitions and detailing the responsibilities of lenders. It also permits reimbursements and direct payments to any person who enters into a settlement agreement with the Department. Finally the legislation aligns due process provisions of HSCA with other state environmental statutes by allowing orders to be issued by the Secretary without a prior public hearing but allowing an appeal to the Environmental Appeals Board.

An Act To Amend Title 7 Of The Delaware Code Relating To Extremely Hazardous Substances Risk Management. [SB-199]
This bill amends the definition of extremely hazardous substance in 7 Del. C., Chapter 77, the Extremely Hazardous Substances Risk Management Act to be consistent with the wording in the federal Clean Air Act Amendments and the federal Risk Management Program. This bill also replaces the three year inspection mandate for the Department of Natural Resources and Environmental Control to inspect facilities regulated by Chapter 77 with an inspection program based on risk and compliance with this Chapter and establishes requirements for inspection notice
