This bill increases the minimum fine for the first offense of Graffiti from “$500” to “$1000” and increases the hours of community service from “200” to “250”. The bill also increases the minimum fine for the second or subsequent offense of graffiti to “$2000” and increases the hours of community services to “500” hours.

An Act To Amend Title 18 Of The Delaware Code Relating To Developmental Screening Of Infants And Toddlers. [HB-199]
This Act requires that private health insurers in Delaware cover the developmental screenings for infants and toddlers that are recommended by the American Academy of Pediatrics and the Delaware Early Childhood Council. Such screenings are already covered for children in the state’s Medicaid program. The estimated cost to policyholders of covering these screenings is three cents per member per month.

This bill requires certain disclosures by the community owner/landlord to the prospective tenant prior to the tenant entering into a lease agreement with the community owner/landlord. In addition, the bill requires that a prospective tenant receive counseling, provided by Delaware Manufactured Homeowners Association, or any subsequent replacement entity therefore, as to material terms of the lease agreement and other relevant documents relating to the manufactured home community. On December 22, 2008, Delaware City Fire Company paramedic Michelle Smith was tragically killed in the line of duty by a reckless driver. Under current Delaware law, a person who recklessly causes the death of an on-duty law enforcement officer, corrections employee or fire fighter is guilty of murder in the first degree and eligible for capital punishment. This Act, named in Michelle’s honor, adds paramedics, EMTs, Fire Marshalls and fire police officers to same statutes, ensuring that any person who recklessly kills one of Delaware’s first responders

This bill increases the penalties for the crime of “sex offender unlawful sexual conduct against a child” when the victim is under the age of eighteen and has a cognitive disability. An Act To Amend Title 25 Of The Delaware Code Relating To Manufactured Homes. [HB-208]
The bill requires that, if a community owner/landlord chooses to provide utility needs to a tenant, the community owner/landlord shall provide such utilities to a tenant at the rate that the community owner/landlord paid to the utility provider or supplier. In addition, as an alternative, the community owner/landlord must allow the tenant to purchase utilities directly from a utility provider or supplier, consistent with a free market system, and at no additional cost to the tenant from the community owner/landlord.
