An Act To Amend Title 25 Of The Delaware Code Relating To Manufactured Home Communities. [HB-392]
This bill requires a landlord to make a community center available to a tenant’s association or, if none, a group of tenants to use to hold meetings addressing matters affecting or relating to the tenants’ rights, obligations, and/or privileges in and/or relating to the manufactured home community. Use of the community center by the tenants for such meeting shall be at no charge and shall be permitted within a reasonable amount of time after the tenant’s association or group of tenants have made a request to the landlord.

This Act aligns Delaware law with the federal requirements of the reauthorized Individuals With Disabilities Education Act relating to the content of prior written notice, the requirements for the appointment of educational surrogates, and the applicable timelines for an administrative due process hearing. An Act To Amend Title 14 Of The Delaware Code Relating To Unit Funding. [HB-436]
With the approval of the General Assembly (through Epilogue) the Delaware Department of Education (DDOE) first piloted the needs based system in two school districts, Brandywine and Seaford. Following the first year of implementation, the needs based structure proved beneficial and provided the districts with more options in the use of resources. An Act To Amend Title 4 Of The Delaware Code Relating To Brewery-pubs And Microbreweries. [HB-447]
This Bill would permit the sale of beer made on the premises to consumers for consumption on the premises similar to that currently permitted under Delaware law for Farm Wineries. This will encourage tourism at the Microbreweries licensed in this State. Delaware law has permitted an individual to have an interest in up to two (2) Brewery-Pubs and a Microbrewery, but a strict reading of 546 would mean that the individual could only sell for consumption off of the premises at two of the three licensed premises. An Act To Amend Title 12 Of The Delaware Code Relating To Durable Powers Of Attorney And Adding A Chapter 49a Thereto Relating To Durable Personal Powers Of Attorney. [HB-455]
This bill does two things. It keeps in place the existing Durable Powers of Attorney statute which is relied upon for commercial transactions, changing only the out-dated reference of “attorney-in-fact” to “agent”; eliminating a provision now covered in the new Chapter 49A, Durable Personal Powers of Attorney; and making clear that 49 is independent of 49A.
