This act improves the licensure and renewal requirements of Delaware law for physicians. Section 1 requires disclosure an applicant for licensure or renewal to disclose any professional regulatory investigation, and requires physicians to be fingerprinted by the State Bureau of Identification at least every ten years. This act improves the reporting process of the Board of Medical Practice by strengthening the Board's authority to police unprofessional conduct and clarifying and simplifying the Board's administrative procedures to improve the efficiency of the board and its ability to work with law enforcement. This act also makes certain similar changes that would affect all boards administered by the Division of Professional Regulation. An Act To Amend Title 11 Of The Delaware Code Relating To Crimes And Criminal Procedure. [HB-485]
This bill defines the Division of Professional Regulation as a "criminal justice agency" for purposes of Chapters 85 and 86 of Title 11. As a result, the Division will be provided greater access to information maintained by the State Bureau of Identification and Delaware Criminal Justice Information System (DELJIS). An Act To Amend Titles 30, 12, And 3 Of The Delaware Code Relating To The Delaware Estate Tax. [HB-492]
Many Delaware domiciliaries own homes in other states that have no estate tax. The Delaware estate tax law could have the unintended effect of causing these Delaware domiciliaries, who currently pay Delaware income tax, to change their state of domicile to another state to avoid the Delaware estate tax, thereby reducing the amount of income tax collected by the State. For this reason, the bill’s provisions will return as they were immediately prior to the date when the present statute was enacted.
