An Act To Amend Title 16 Of The Delaware Code Relating To Tick Control. [HB-290]
This Act is the result of the findings of the Lyme Disease Prevention Task Force (“the Task Force”). On June 1, 2015, the Task Force issued a report that made several recommendations. One of the recommendations was to “[d]evelop on a statewide basis a science-based Integrated Pest Management strategy incorporating acaricide use, biological controls, management of tick-host animals and backyard habitat management.” To implement this strategy, the Task Force recommended a change to state law to allow the Department of Natural Resources and Environmental

An Act To Amend Title 16 Of The Delaware Code Relating To The Creation Of An Oversight Board To Educate Health Care Professionals About Lyme Disease. [HB-291]
Lyme disease is caused by the bacterium Borrelia burgdorferi and transmitted through the bite of an infected tick. Typical symptoms include fatigue, fever, and headache. Without treatment, the infection can damage the joints, heart, and central nervous symptom, resulting in meningitis, temporary facial paralysis, and impaired muscle function. Newly-diagnosed patients can be treated with antibiotics. Even with treatment, many patients experience chronic symptoms. Due to the general nature of the symptoms and lack of awareness or understanding of

An Act To Amend Title 24 Of The Delaware Code Relating To The Delaware Board Of Examiners Of Psychologists. [HB-322]
This bill updates the Delaware Code relating to the Delaware Board of Examiners of Psychologists. Section 1 ensures that the internship requirement for applicants for psychological assistant registration is equivalent to the internship required of applicants for psychologist registration. This will prevent situations in which an applicant who qualifies for registration as a psychological assistant is then not qualified for registration as a psychologist as he or she did not complete an adequate internship. An Act To Amend Title 24 Of The Delaware Code Relating To The Board Of Dentistry And Dental Hygiene. [HB-323]
This bill updates the Delaware Code relating to the Delaware Board of Dentistry and Dental Hygiene regarding the exemption from unlicensed practice for owners and operators of non-profit tax exempt organizations that provide dental care. The current statute prevents such facilities from charging any fees for service and limits such facilities to those affiliated with a hospital. In addition, in its current form, the statute appears to allow such owners and operators to perform dental services regardless of the individual’s qualifications.

An Act To Amend Title 4 And Title 29 Of The Delaware Code Relating To The Joint Sunset Committee. [HB-343]
The Joint Sunset Committee has existed since at least 1980 and, over time, it has become clear that the Committee's name does not accurately reflect all of the work that the Committee actually performs. The Committee has "sunsetted" an agency under review only twice in the history of the Committee’s existence: the Unemployment Appeals Board in 2003, which was reformed in 2005, and the Council on Manufactured Housing in 2015. Because "sunsetting" an agency is only one of the Committee’s many functions, the name "Joint Sunset Committee" has also grown

An Act To Amend Title 4 Of The Delaware Code Relating To Alcoholic Liquors. [HB-351]
The Appeals Commission recently ruled that the Commissioner does not have standing to appear before the Appeals Commission. This means that an appeal of the Commissioner’s decision on an unprotested application would result in the appealing party appearing uncontested before the Appeals Commission. The Supreme Court recently ruled that the Commissioner does not have standing to appeal decisions rendered by the Appeals Commission or the Superior Court. The predecessor to the Commissioner (the Alcoholic Beverage Control Commission) was permitted
