This bill amends the Delaware Code concerning barber licensing by permitting the merger of classroom instruction and an apprenticeship to attain licensure. Specifically, a combined 600 classroom instructional hours and 1500 apprenticeship hours will qualify the candidate for licensure barber licensure. This bill also inserts cosmetologist apprentice language in the appropriate subsection.

An Act To Amend Title 14 Of The Delaware Code Relating To Establishing A School Safety And Security Fund. [HB-34]
This Act establishes the Delaware School Safety and Security Fund to allow eligible public schools to compete for grant awards to partially or fully fund projects intended to improve school safety or security. An Act To Amend Titles 10 And 16 Of The Delaware Code Relating To Nonviolent Drug Offenders. [HB-343]
This bill amends Title 16 (Health and Safety) by substituting the “Delaware Crime Prevention and Rehabilitation Act” (DCPRA) for the “First offenders controlled substance diversion program.” Specifically, the DCPRA extends its coverage beyond first offenders to those that are by definition “nonviolent drug offenders.” Under this Act sentencing of these offenders mandatorily will emphasize an individualized drug treatment and rehabilitation component that is crafted by treatment providers and delivered at Drug Treatment and Rehabilitation centers

This bill makes the following changes to Delaware Statutory Trust Act (the “Act”) to keep it current and to maintain its national preeminence. The following is a section-by-section review of the proposed amendments of the Act. Section 1. This section amends 3803(d) of the Act to clarify that a defense of usury shall not apply to obligations of a beneficial owner or trustee of a statutory trust owed to a beneficial owner or trustee of a statutory trust when the obligations arise under the governing instrument or a separate agreement in writing.

An Act To Amend Title 31 Of The Delaware Code Relating To Child Care. [HB-366]
This bill allows a licensee or a potential licensee of Child Care to appeal a decision by the Secretary of DSCYF to revoke, suspend or deny their application for a license. This appeal would go to Superior Court on the record and pursuant to the Administrative Procedures Act. Currently, there is no direct appeal right to Superior Court for a licensee or potential licensee. An Act To Amend Title 11 Of The Delaware Code Relating To Penalties For Possession Of A Firearm During The Commission Of A Felony. [HB-37]
Currently 1447A punishes the possession of a firearm during the commission of a felony but does not differentiate between persons having a firearm in their possession and persons who use the firearm during the commission of a crime. This Act makes this distinction and provides enhanced penalties for those displaying and discharging a firearm, and causing serious physical injury to a non-participant during the commission of a crime.
