An Act To Amend 24 Of The Delaware Code Relating To The Board Of Chiropractic. [HB-416]
This Act prevents unreasonable deductibles, copayments or coinsurance charges for chiropractic care. Some managed care providers have arbitrarily classified chiropractors as “specialists” in order to charge copayments and deductibles that are in excess of those charged for primary care medical doctors. This Act establishes that the maximum amount of any deductible, copayment of coinsurance charge for chiropractic care shall be the lesser of either: (i) the deductible or copayment for a primary care physician or 15% of the fee due to be paid to the (continued...)

An Act To Amend Title 18 Of The Delaware Code Relating To Health Insurance [HB-420]
This Act is intended to prohibit the practice of “post-claims underwriting” by health insurers, as defined in Title 18 of the Delaware Code. Underwriting is the practice of determining, based upon information provided by an applicant for an insurance policy about the applicant’s health and background, whether the insurance company should offer the applicant a policy and, if so, what should be the terms and the cost of the policy. Health insurance underwriting normally is completed prior to the issuance of an insurance policy. Post claims underwriting (continued...)

A consumer legal finance transaction is one in which person assigns a contingent right to receive an amount of the potential proceeds of their legal claim to Consumer Legal Finance Company in exchange for money. An Act To Amend Title 14 Of The Delaware Code Relating To Unit Funding. [HB-436]
With the approval of the General Assembly (through Epilogue) the Delaware Department of Education (DDOE) first piloted the needs based system in two school districts, Brandywine and Seaford. Following the first year of implementation, the needs based structure proved beneficial and provided the districts with more options in the use of resources. Since the 2004-2005 school year, the General Assembly authorized (through Epilogue) the implementation of the needs based formula in twelve of the nineteen school districts. As of the 2009-2010 school year, (continued...)

An Act To Amend Title 26 Of The Delaware Code Relating To Certificates Of Public Convenience And Necessity For Wastewater Treatment Utilities. [HB-442]
This bill clarifies the intent of the General Assembly that wastewater utilities may not obtain a certificate of public convenience and necessity in the existing service territory of a government entity. This bill also addresses the practice by New Castle County of claiming a wide wastewater service territory but refusing to provide service and objecting to any application of a regulated wastewater utility for a certificate of public convenience and necessity from the Public Service Commission. An Act To Amend Titles 10, 11, 16 And 21 Of The Delaware Code Relating To Drug Laws, Crimes And Criminal Procedure, Sentencing Accountability, Courts And Judicial Procedure, And Motor Vehicles. [HB-443]
This Act substantially revises drug crimes and related offenses. It replaces the current system, where the most serious offense – drug trafficking – is defined solely by the weight of the drugs, where the various felony offenses have little logical relationship to one another, and where possession of one dose of a drug, intended for personal use, often can be prosecuted as a felony. This Bill provides for a structured system of felony offenses, which would be 4752-56 of Title 16, in which the various considerations that are usually considered to (continued...)

An Act To Amend Title 4 Of The Delaware Code Relating To Brewery-pubs And Microbreweries. [HB-447]
This Bill would permit the sale of beer made on the premises to consumers for consumption on the premises similar to that currently permitted under Delaware law for Farm Wineries. This will encourage tourism at the Microbreweries licensed in this State. Delaware law has permitted an individual to have an interest in up to two (2) Brewery-Pubs and a Microbrewery, but a strict reading of 546 would mean that the individual could only sell for consumption off of the premises at two of the three licensed premises. This Bill makes clear that the provisions (continued...)
