An Act To Amend Title 10 Of The Delaware Code Relating To Code Enforcement Constables. [HB-308]
This Act allows the chief executive of a county or municipality to appoint animal control agents as constables. House Bill 233 of the 145th General Assembly transferred administrative powers and duties relating to dogs and dog control to the counties effective January 1, 2010. This Act is necessary to provide the counties with authority to enforce their respective ordinance pertaining to dogs and dog control. Pursuant to the Act, animal control constables are granted the same authority as other code enforcement constables.

An Act To Amend Title 18 Relating To Captive Insurance Companies. [HB-314]
This legislation amends chapter 69 of title 18 of the Delaware Code by adding two types of captive insurance companies to those that can currently be licensed in Delaware. The two new forms of captive insurance companies are “agency captive insurance companies” and “branch captive insurance companies.” Agency captive insurance companies are reinsurance companies owned by insurance agents or brokers who underwrite and place insurance policies for conventional insurance companies. This bill provides that any person who solicits door to door sale shall display a door to door salesperson identification card which shall include the person’s name, employer, employer telephone number, employer address and State of Delaware business license number. This bill also provides that door to door sales shall only be solicited between the hours of 9 a.m. to 7 p.m.

An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-322]
This Act corrects a loop-hole in Delaware’s felony resisting arrest statute identified by the Delaware Supreme Court’s recent opinion in Watson v. State, No. 335, 2009 (January 6, 2010). In Watson, two probation and parole officers were injured by a defendant while trying to make an arrest for a probation violation. On appeal, the Delaware Supreme Court reversed Watson’s convictions for the felony offense of resisting arrest by force or violence under 1257(a) because the statute, by its express terms, only applies to arrests by police officers.

This Act recognizes a military service member’s executed Record of Emergency Data Form (DD Form 93) as a valid declaration instrument governing the disposition of the service member’s last remains in the event of death. Pursuant to Federal law (Section 564 of Public Law 109-163), military service members must execute a DD Form 93 designating a person authorized to direct disposition of their remains in the event of death. Section 1 of this bill would require schools to seek the signature from each parent of a parent/school compact at the beginning of each school year, reflecting an updated Parents’ Declaration of Responsibilities to be prepared by the State and parent organizations. An Act To Amend Title 7 Of The Delaware Code Relating To Environmental Control. [HB-355]
This Bill requires an expedited authorization process for the replacement or rebuilding of docks, piers, or bulkheads when they are being rebuilt on the existing or previously existing structural footprint. If the Secretary wrongfully denies such application the State shall be liable for the applicant’s reasonable attorney fees and expenses. The State’s immunity to liability is expressly waived.
