Delaware employment discrimination law applies to employers of 4 or more employees within the State for all protected classes (race; marital status; genetic information; color; age; religion; sex; sexual orientation; gender identity; national origin) apart from disability. Only larger employers with 15 or more employees are subject to the State disability-based employment discrimination law. An Act To Amend Title 21 Of The Delaware Code Relating To Motor Vehicle Safety- Responsibility. [SB-192]
This Bill respectfully responds and reacts to the well-reasoned decision in the matter State of Delaware Insurance Coverage Office v. Rabrinda Choudry and Debjani Choudry, C.A. No. N12A-08-003 RRC and codifies the longstanding position of the State of Delaware that it is a self-insurer within the scope of 21 Del. C. 2904. Specifically, this Bill is intended to restore the State’s participation in Insurance Commissioner’s Arbitrations with respect to certain of its subrogation actions as required by 29 Del. C. 2118(g)(3).

An Act To Amend Title 21 Of The Delaware Code Relating To Motor Vehicles. [SB-195]
The purpose of this amendment is to allow injured persons of motor vehicle collisions to maximize their personal injury protection benefits by allowing injured persons to direct the way in which personal injury protection benefits are to be administered. The only exception to this is that properly submitted expenses for basic life support services, provided by a certified volunteer ambulance company, shall be paid regardless of any direction otherwise. This amendment is made in the spirit of Delaware court decisions such as Gray v. Allstate Ins.

An Act To Amend Title 9 Of The Delaware Code Relating To Dangerous Dogs. [SB-196]
This bill restores language to the Delaware Code that was inadvertently repealed in 2010 when SB 240 and HB 419 were enacted concurrently. This bill adds cats to the list of domestic animals that are protected under the dangerous dog law. Cats are domestic animals and dogs that viciously attack a cat on the property of its owner or under the immediate control of its owner should be evaluated according to dangerous dog provisions.
