This bill provides that a person who stands in a position of trust, authority or supervision over a child who is at least 16 years old but not yet 18 years old and intentionally engages in sexual intercourse or sexual penetration with such child or an invitee or designee of such person shall have committed the offense of Rape in the 3rd degree which is a class B felony. This offense is currently Rape in the 4th degree which is a class C felony.

An Act To Amend Title 6 Of The Delaware Code Relating To Home Solicitation And Door To Door Sales. [HB-317]
This bill provides that any person who solicits door to door sale shall display a door to door salesperson identification card which shall include the person’s name, employer, employer telephone number, employer address and State of Delaware business license number. This bill also provides that door to door sales shall only be solicited between the hours of 9 a.m. to 7 p.m.

An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-322]
This Act corrects a loop-hole in Delaware’s felony resisting arrest statute identified by the Delaware Supreme Court’s recent opinion in Watson v. State, No. 335, 2009 (January 6, 2010). In Watson, two probation and parole officers were injured by a defendant while trying to make an arrest for a probation violation. On appeal, the Delaware Supreme Court reversed Watson’s convictions for the felony offense of resisting arrest by force or violence under 1257(a) because the statute, by its express terms, only applies to arrests by police officers.

This Act recognizes a military service member’s executed Record of Emergency Data Form (DD Form 93) as a valid declaration instrument governing the disposition of the service member’s last remains in the event of death. Pursuant to Federal law (Section 564 of Public Law 109-163), military service members must execute a DD Form 93 designating a person authorized to direct disposition of their remains in the event of death. An Act To Amend Title 11 Of The Delaware Code Relating To Crimes And Criminal Procedure [HB-346]
This bill makes it illegal to knowingly possess visual depictions of the intentional torture or killing of an animal. For a person to be found guilty under this statute, such person must knowingly and voluntarily possess the depiction. The underlying act must also be illegal under existing Delaware or federal law. For example, under Delaware law, acts of animal cruelty, cockfighting and dogfighting are illegal, and this law would ban the intentional depiction of such acts.
