An Act To Amend Title 11 Of The Delaware Code Relating To Certain Property Crimes. [HB-185]
This Act raises the penalties for the three property crimes that have enhancements for property losses in excess of $50,000 and $100,000. When the loss is in excess of $50,000, the crime would be a class D felony (0 to 8 years imprisonment) instead of a class E felony (0 to 5 years imprisonment) or class F felony (0 to 3 years imprisonment). When the loss is in excess of $100,000, the crime would be a class B felony (2 to 25 years imprisonment) instead of a class C felony (0 to 15 years imprisonment).

This Act is the product of the ‘Drug Law Revisions Committee.’ This Act repeals a significant portion of the existing criminal drug laws. In their place, this Act creates three main drug crimes – Drug Dealing (that is, delivery or manufacture, or possession with intent to deliver or manufacture); Aggravated Possession (that is, possession of amounts generally indicative of drug dealing but where drug dealing need not be proved); and Possession. This bill is a companion bill to a constitutional amendment to allow the General Assembly to determine photographic and signature identification requirements to vote. This bill is modeled after Florida’s law. An Act To Amend Title 21 Relating To Rules Of The Road. [HB-202]
This Bill makes it an offense to use a handicapped plate or placard issued to another person, unless that person is also in the vehicle. The Bill aims to curb the use of handicapped parking spaces by persons who do not actually need them. Under the Code, a person who violates this provision will “receive a mandatory fine of $100 for a first offense, and for a subsequent like offense, a mandatory fine of $200 or a term of imprisonment of not less than 10 nor more than 30 days, or both.”
