This bill is intended to encourage the reporting of suspected financial exploitation of the elderly and infirm adults by providing immunity from criminal and civil liability for making such reports. Under the bill, anyone who makes a good faith report to law enforcement authorities of such suspected activity is immune from criminal and civil liability for making that report. In addition, any person that adopts a formal written program for reporting suspected financial fraud is immune from civil or criminal liability for any report, act, or omission

This bill creates the Delaware Predatory Refund Anticipation Lending Prevention Act which prohibits unfair lending practices in relation to loans in advance of tax returns, and provides civil and administrative enforcement procedures. This bill would provide needed consumer protections for the Citizens of Delaware, and help to safeguard the economic vitality of our State.

An Act To Amend Title 21 Of The Delaware Code Relating To Driving A Vehicle While Under The Influence. [HB-315]
This Act protects the community by increasing the level of services and supervision applicable to those individuals convicted of Driving Under the Influence. The Act protects residents of the State of Delaware by requiring mandatory use of approved ignition interlock devices and participation in victim’s interaction sessions for first-time offenders. Similarly, this Act requires mandatory in-patient substance abuse treatment, Continuous Remote Alcohol Monitoring, and ongoing substance abuse testing for second-time offenders.

Consistent with Delaware’s Child Victim’s Act, this Act clarifies that civil actions based on sexual abuse of a patient by a healthcare provider may be filed at any time after the commission of the abuse. This Act also creates a 2-year “look-back” provision in cases of abuse which was unknown and could not reasonably have been discovered by the patient.
