An Act To Amend Title 13 Of The Delaware Code Relating To Marriage. [HB-154]
This Bill increases from four (4) to fifteen (15) days the time by which a person officiating a marriage ceremony must return the marriage certificate to the issuing Clerk of the Peace for recording. The Act also increases the penalty on those fail to comply from $25 to $50 and authorizes the issuing Clerk of the Peace to temporarily suspend a person’s authorization to solemnize marriages until any delinquent penalties are paid in full.

An Act To Amend Titles 10 And 11 Of The Delaware Code Relating To Records Of Arrest And Prosecution. [HB-169]
This Act eliminates the five-year waiting period for a person who has successfully completed the Probation Before Judgment (“PBJ”) program, and the two-year waiting period for a person who has successfully completed the First Offenders Controlled Substances Diversion Program (“CSDP”), to obtain an expungement of the arrest and conviction records relating to that offense. This bill requires that a person elected to a state office or appointed to fill a vacancy in an elective state office, or who has filed as a candidate for an elective state office disclose the name and address of every nonprofit organization, civic association, community association, foundation, maintenance organization, or trade group incorporated in the State or having activities in the State, or both, of which the person is a council member or board member.

An Act To Amend Title 29 Of The Delaware Code Relating To The Assessment Of A Prosecution Fee. [HB-175]
This legislation recognizes that one of the consequences of crime is that employees of the Department of Justice are required to prosecute the offenses. When a defendant is held to be responsible for an offense, requiring the defendant to make a payment acknowledging the cost to the State serves the purposes of the criminal justice system. In addition, the courts are given discretion to reduce or waive the fee when the defendant timely acknowledges responsibility for an offense.
