An Act To Amend Title 29 Of The Delaware Code Relating To The State Employees Pension Plan. [HB-363]
In the 147th General Assembly, the state employee pension law was amended to permit corrections officers employed in positions that are classified as Hazardous Duty Level A-1 to retire at 25 years without any reduction. Those employees will pay a higher employee contribution rate. Those employees that continue to work past 25 years of service will have the multiplier used in the calculation of benefits increased for the years past 25 years. An Act To Amend Title 6 Of The Delaware Code Relating To Funds Transfers. [HB-364]
The Electronic Funds Transfer Act (“EFTA”) was originally drafted to govern only consumer wire transfers. As a result, 4A-108 of Title 6 of the Delaware Code excluded fund transfers governed by EFTA from the scope of Article 4A of Title 6 (“Article 4A”). However, in 2010, the Dodd-Frank Wall Street Reform and Consumer Protection Act amended EFTA (“Dodd-Frank amendments”) to bring remittance transfers that are electronic fund transfers within its scope. This bill amends the definition of family to make spouses and couples gender neutral. This bill also permits the transfer of misdemeanor criminal jurisdiction in cases involving former spouses, persons cohabitating with or without a child in common, and persons living apart with a child in common from the Court of Common Pleas to Family Court. An Act To Amend Title 15 Of The Delaware Code Relating To Primary Elections. [HB-375]
This bill moves the date of primary elections for statewide office, county office, and municipal office to the fourth Tuesday in April, which is the date of the presidential primary. An Act To Amend Title 18 Of The Delaware Code Relating To Funding Agreements. [HB-378]
This bill amends the insurance law to clarify the status of funding agreements issued by life insurers, including for purposes of premium taxes, form filing and priority of claims in an insurer’s delinquency proceeding. An Act To Amend Title 18 Of The Delaware Code Relating To Pre-authorization. [HB-381]
