An Act To Amend Titles 16 And 24 Of The Delaware Code Relating To The Reporting Of Abuse And Unprofessional Practice. [SB-297]
This act promotes the reporting of child abuse and allegations of unprofessional practice by healthcare practitioners and institutions. Section 1 clarifies that the mandatory duty to report child abuse or neglect applies to all persons, and specifically includes institutions such as hospitals, nursing homes and the Medical Society. An Act To Amend Title 24 Of The Delaware Code Relating To The Imposition Of Fines By The Board Of Medical Practice. [SB-298]
This act increases the incentive for persons with a mandatory reporting obligation under the Medical Practice Act to comply with their obligation under that Act. Sections 1 and 2 of the bill give the Board of Medical Practice additional flexibility to impose appropriate fines by increasing the range of fines from a maximum of $5,000 to a maximum of $10,000 for a first violation and $50,000 for a subsequent violation. An Act To Amend Title 11relating To Sentencing And Good Time. [SB-320]
The ability of inmates to earn good time credits was a mechanism established to assist and encourage appropriate behavior by inmates while they are incarcerated. This general concept has been modified by the General Assembly over time to prohibit good time credit for specific offenses. Unfortunately, this ad hoc application has caused significant administrative issues to arise that are difficult to address with limited staff and is inconsistent with the original intent and purpose of good time credit. An Act To Amend Title 25 Of The Delaware Code Relating To Solar Photovoltaic Systems And Amendments To Deed Restrictions. [SB-49]
This Bill enables the use of rooftop solar systems on privately owned residential dwellings by limiting the use of covenants or other restrictions beginning January 1, 2010 but does not impact restrictions in effect prior to then . This bill also permits any deed restrictions which are silent as to how they may be amended may hereafter be amended by a vote of no more than 75% of the property owners. Restrictions concerning solar collectors on roofs may be amended by two-thirds of the property owners.

An Act To Amend Title 18 Of The Delaware Code Relating To Dental Insurance And Children With Severe Disabilities. [SB-65]
Parents of children with severe disabilities experience difficulty in identifying practitioners willing and able to provide effective dental care. Children with autism or mental deficiency are often uncooperative with treatment. Children with postural or mobility impairments may be unable to transfer from a wheelchair or sit in a standard dental treatment chair. Strict application of “in-network” insurance restrictions exacerbates the parents dilemma since there may be no nearby in-network dentist willing and able to treat their child. An Act To Amend Title 14 Of The Delaware Code Relating To Compensation For Education Professionals. [SB-67]
This bill would allow teachers who demonstrate objectively measured efforts to improve the academic performance of their students during the preceding school year to receive financial bonuses, and teachers who do so in high risk schools to receive additional bonuses. Financial bonuses are already made available under existing law to teachers who take additional professional development classes, obtain certifications, and accepting additional responsibilities that impact student achievement. An Act To Amend Title 14 Of The Delaware Code Relating To Student Assessment And Academic Promotion. [SB-68]
This legislation eliminates the DSTP, and requires its replacement beginning in the 2010-2011 school year with a test administered at a minimum in each grade level 2 through 10 at the beginning of the school year and at least one more time later in the year, to assess student progress over the course of the year as well as providing a benchmark for student, school, and district achievement. An Act To Amend Titles 10 And 29 Of The Delaware Code Relating To Real Property Acquisition And Eminent Domain. [SB-7]
This Bill requires state, county, or municipal governments, or State agencies or other condemning entities to use their eminent domain authority solely for “public use” and defines that term. The Bill specifically states that benefits derived from economic development do not constitute a public use. The Bill also includes notice to property owners of the asserted public use and this policy.
