This legislation designates court security positions in the Court of Common Pleas and uniformed services supervisor positions in the Justice of the Peace Court as exempt from the State of Delaware Merit Rules, thereby placing them under the Judicial Branch Personnel Rules, consistent with similar positions in the Superior Court. Section 2 of this Act allows any incumbent to elect to be governed by the Judicial Branch Personnel Rules or remain in the Merit System.

This Bill requires an auctioneer who is providing real estate services other than advertising and marketing real property for sale by auction, selling the property by auction on the day advertised, and performing ministerial tasks necessary for settlement to comply with the license requirements of Title 24, Chapter 29. If the original bidder is not able to complete settlement, then the auctioneer may offer the property on the same terms to other registered bidders.

This bill forbids the possession, sale, offer for sale, and distribution of shark fins in the State of Delaware. Shark finning (whereby a shark is caught, its fins cut off and the carcass dumped back in the water while the shark is still alive) is already prohibited by federal law and Delaware regulations and is not currently being practiced by Delaware fishermen. This bill would place limits on the use of solitary confinement, a topic which is largely unaddressed in current Delaware law. A growing body of research shows that long-term solitary confinement may contribute to significant mental health issues and reentry problems. Of particular concern is the impact of the practice on juveniles and the mentally ill. In 1999, House Bill 332 established new response time goals and certification standards for the delivery of basic life support and emergency medical services. In order to meet the new standards, volunteer ambulance companies needed to hire paid EMTs and ambulance attendants to ensure the availability of sufficient numbers of trained, certified staff on a 24 hour, 7 days a week basis to meet the new response time goals.
