An Act To Amend Titles 16 And 24 Of The Delaware Code Relating To The Regulation, Investigation And Inspection Of Unsanitary Or Unsafe Conditions In Facilities Where Invasive Medical Procedures Are Performed. [HB-47]
This bill provides the Department of Health and Social Services with the explicit authority to investigate and inspect unsanitary or unsafe conditions in certain facilities where invasive medical procedures are performed. It also gives DHSS the authority to adopt regulations to strengthen oversight of facilities. In addition, it provides that the Department of State, Division of Professional Regulation may investigate and inspect unsanitary and unsafe conditions maintained by individuals licensed by the Board of Medical Licensure and Discipline. An Act To Amend Titles 11, 16 And 29 Of The Delaware Code Relating To Reporting Persons Prohibited From Possessing Firearms And The National Criminal Instant Background Check System ("nics"). [HB-48]
The National Instant Criminal Background Check System (NICS) Improvement Act of 2007 was enacted by Congress in response to the Virginia Tech shooting tragedy. Among other things, it requires states to provide certain information to the federal National Instant Criminal Background Check System (“NICS”) database about persons prohibited from possessing firearms, including mentally ill individuals. An Act To Amend Title 7 Of The Delaware Code Relating To Hunting, Trapping, And Fishing Licenses. [HB-61]
Section 505 of Title 7 allows certain members of the military who live and/or serve in Delaware to obtain a fishing license in Delaware regardless of their legal state of residency. This bill clarifies the law to permit members of Delaware’s National Guard who are residents of neighboring states to like-wise obtain a Delaware fishing license. The current wording of the section inadvertently excludes National Guard members because they are not on “full-time active duty” status.

An Act To Amend Title 21 Of The Delaware Code Relating To Motorcycles. [HB-95]
This bill eliminates the requirement that a person must have a safety helmet in their possession while operating or riding on a motorcycle. This bill does not change the requirement in Title 21 of the Delaware Code that a person up to 19 years of age must wear a safety helmet while operating or riding on a motorcycle.

An Act To Amend Title 30 Of The Delaware Code Relating To The Personal Income Tax. [HB-97]
This Bill excludes from income taxes pensions received from the United States, including military retirement income, up to a maximum of $37,500.00 less any Social Security benefits paid by the United States in the taxable year. It is intended to equalize the treatment of Federal retirees who are not covered or are partially covered by the Social Security System with those retirees receiving Social Security benefits which are presently exempt from tax.
