This Bill amends the Public Employment Relations Act to clarify the police officers and other law enforcement officers provided for in paragraph 9 must be certified as required by the Delaware Police Training Program. An Act To Amend Title 21 Of The Delaware Code Relating To Failure To Answer A Summons. [HB-61]
Among the penalties for failure to answer a summons is the charge of “Failure to Answer a Summons” spelled out in 21 Del. C. 702. However, the current processes for the return of a summons includes the ability of a court to issue a capias or bench warrant for failure to appear, which, instead of adding another charge to the defendant, prompts the defendant to return and deal with the existing charge or be arrested on the capias. An Act To Amend Title 7 Of The Delaware Code Relating To Protected Wildlife. [HB-67]
This act increases the penalties for illegally hunting wild turkeys. Delaware began its Wild Turkey Restoration project in 1984 with the release of 34 trapped birds from Pennsylvania, New Jersey and Vermont. To enhance genetic diversity and speed up the stocking of birds in all available habit, additional wild turkeys were acquired from other states, at a cost of approximately $500.00 per bird. Although the cost to purchase and import wild turkeys is very expensive, the penalties levied on individuals who illegally hunt these birds are minimal.

An Act To Amend Title 21 Of The Delaware Code Relating To Habitual Offenders Status For Driving During A Period Of Suspension Or Revocation. [HB-68]
Under current law, if a person is arrested for driving with a suspended license and the judge finds that the sole reason for the suspension is that the person failed to pay a traffic ticket eligible for voluntary assessment, the lesser penalties for failure to reinstate apply in lieu of the penalties for driving during suspension. The General Assembly has further provided that a conviction for failure to reinstate obtained under such circumstances may not be considered for purposes of establishing habitual offender status. A Bill To Amend Title 21 Of The Delaware Code To Expand The Move On Over Law To Include Tow Trucks. [HB-71]
The current Move On Over law applies to police and stationary authorized emergency vehicles of the Department of Transportation. The law, which is helping to reduce the risk of serious injuries and death to public servants who are working in harm’s way, currently does not apply to tow trucks that are not authorized vehicles of the Department of Transportation. An Act To Amend Title 14 Of The Delaware Code Relating To Financial Assistance For Higher Education For Those Serving In The Delaware National Guard. [HB-73]
The Act makes several changes to the Delaware National Guard Educational Benefits program. Section 1 requires State-supported institutions to charge members the in-state rate for tuition and fees regardless of the members’ state of residence. Sections 2 and 3 make changes to allow members to pursue master’s degree programs.
