Delaware law currently does not allow the parties in commercial loan situations to agree to require insurance policies be given to lenders as evidence of insurance on the collateral, thus inhibiting the freedom of contract. The purpose of this change is to allow parties to have such an arrangement be an enforceable contract. This change does not affect residential owners, who were the intended beneficiaries of the law.

An Act To Amend Title 16 Of The Delaware Code Relating To Fire Prevention. [HB-376]
This Act updates Delaware’s Fire Prevention Regulations to require installation of floor proximity emergency lighting and floor proximity exit signs in all new buildings, occupancy conversions, mixed occupancy buildings and additions and repairs to existing buildings. Floor Proximity Exit Signs shall be installed in addition to exit signs currently required under Delaware’s Fire Prevention Regulations.

This Act makes a technical correction to the Delaware Code. In particular, during the First Session of the 145th General Assembly, the State Board of Education asked to be removed from oversight of the school bus regulations (HB 231 w/SA 1). This Act clarifies the scope of oversight for the design and operation of school buses by the Secretary of Education, with the advice of the Director of Division of Motor Vehicles (DMV). An Act To Amend Title 30 Of The Delaware Code Relating To Economic Development Incentives. [HB-380]
This proposed tax credit intends to create incentives for existing businesses to partner with the State in the effort to create new employment opportunities for Delaware citizens, and to stimulate the Delaware economy by expanding the tax base. A finder’s fee, a tool used commonly by businesses, is an arrangement by which an intermediary finds, introduces, and brings together parties to a business opportunity. This bill creates a tax credit program that would award each Sponsor Firm and each New Business Firm with a $500 annual tax credit per Delaware

An Act To Amend Title 15 Of The Delaware Code Relating To Elections. [HB-381]
Current Delaware law allows individuals 18 and older, and those who will turn 18 before the next general election, to register to vote through the Division of Motor Vehicles. This act would allow 16 year olds to register to vote through the Division of Motor Vehicle at the time they first apply for their driver’s license. Such individuals, however, will not be allowed to vote unless they will turn 18 before the next general election.

An Act To Amend Title 16 Of The Delaware Code Relating To Controlled Substances [HB-382]
This bill corrects an error in the Delaware Code provision relating to the sale of pseudoephedrine or ephedrine. The law currently provides that a licensed pharmacist, sales clerk or “licensed pharmacy technician” shall require that any person purchasing, receiving, or otherwise acquiring any substance containing pseudoephedrine or ephedrine shall be age 18 or older and show a photo ID. The law requires pharmacists, sales clerks and “licensed pharmacy technicians” to check for ID and to maintain a written log of all pseudoephedrine or ephedrine

An Act To Amend Title 21 Of The Delaware Code Relating To The Registration Of Motor Vehicles. [HB-388]
This bill increases the penalties for vehicle owners who are not complying with Delaware law by not registering their vehicles after establishing residency in Delaware. The current fine of $25 provides no incentive for vehicle owners to register their vehicles in Delaware. This results in the loss of a significant amount of revenue. An Act To Amend Title 29 Of The Delaware Code Relating To Lotteries. [HB-389]
This act creates a new class of gaming institution in Delaware through exclusive authorization of a limited lottery license. A limited lottery license can only be granted to a private club with no more than 5,000 members with a minimum membership fee of $10,000. A limited lottery license expressly prohibits the licensee from operating video lottery machines, restricting gaming activity to table games and sports lottery machines operated exclusively for the enjoyment of members and their guests.
