An Act To Amend Title 6, Chapter 73 Of The Delaware Code To Permit Delaware Businesses To Raise Capital Through Intrastate Crowdfunding Activities. [HB-327]

An Act To Amend Title 29 Of The Delaware Code Relating To State Recognition Of The Lenape Indian Tribe Of Delaware. [HB-345]
Under this Act, the General Assembly formally recognizes the Lenape Indian Tribe of Delaware ("the Tribe") as an American Indian tribe, not only to acknowledge the Tribe's rich history and culture, but also so that the Tribe may be recognized as eligible for the programs and services that the United States provides to Indians because of their status as Indians. For example, the federal Indian Arts and Crafts Act establishes the Indian Arts and Crafts Board ("the Board") of the U.S. Department of the Interior and authorizes the Board to establish

An Act To Amend Title 25 Of The Delaware Code Relating To Property. [HB-353]
This bill eliminates the requirement that a mortgage be under seal in order for it to be enforced through a foreclosure proceeding in the Superior Court pursuant to Chapter 49 of Title 10. The under seal requirement is most prominently described in the case of Monroe Park v. Metropolitan Life Ins. Co., 457 A.2d 734, 736 (Del. 1983) (“[I]t is well settled that unless the seal requirement is abolished by statute, a mortgage must be under seal to be enforceable at law.”). An Act To Amend Titles 11 And 31 Of The Delaware Code Relating To Solitary Confinement. [HB-36]
This bill would place limits on the use of solitary confinement, a topic which is largely unaddressed in current Delaware law. A growing body of research shows that long-term solitary confinement may contribute to significant mental health issues and reentry problems. Of particular concern is the impact of the practice on juveniles and the mentally ill. Therefore, this Act would limit the amount of time that a person may be ordered into solitary confinement as part of their sentence to 4 weeks, rather than 3 months. Additionally, the bill would

An Act To Amend Title 6 Of The Delaware Code Relating To Funds Transfers. [HB-364]
The Electronic Funds Transfer Act (“EFTA”) was originally drafted to govern only consumer wire transfers. As a result, 4A-108 of Title 6 of the Delaware Code excluded fund transfers governed by EFTA from the scope of Article 4A of Title 6 (“Article 4A”). However, in 2010, the Dodd-Frank Wall Street Reform and Consumer Protection Act amended EFTA (“Dodd-Frank amendments”) to bring remittance transfers that are electronic fund transfers within its scope. Therefore, under 4A-108 of Title 6, even a remittance transfer that is not an electronic fund

An Act To Amend Title 31 Of The Delaware Code Relating To Eligibility For Public Assistance. [HB-365]
This Act removes the prohibition against receipt of Temporary Assistance for Needy Families (“TANF” also referred to by the name Aid for Families with Dependent Children or “AFDC”) funds by persons convicted of a drug felony. Even though federal laws such as PRWORA passed during the War on Drugs frequently prohibited access to public assistance for persons with drug felonies, these laws also gave states flexibility in determining eligibility for food aid and cash assistance for families with children when applicants had a criminal conviction.
