An Act To Amend Title 10 Of The Delaware Code Relating To The Juvenile Civil Citation Program. [HB-442]
This Act expands the Juvenile Civil Citation Program to provide law enforcement officers with the discretion to refer any first-time juvenile offender engaged in any misdemeanor-level behavior to the civil citation program, where the juvenile can be required to participate in counseling, treatment, community service, or any other appropriate intervention. A juvenile who successfully completes the requirements of the civil citation program will not have an arrest or prosecution indicated on their record. An Act To Amend Title 4 Of The Delaware Code Related To Collection Of Tax On Alcoholic Beverages. [HB-444]
Section 1 of this Act allows those licensed as importers to pay tax upon the sale of alcoholic beverages to customers, instead of the tax being due when the alcoholic beverages come to rest in the State of Delaware. Section 2 of this Act provides that if any of the provisions are found to be unconstitutional, the remaining provisions will stand. Section 3 of this Act provides that the legislation will be effective as of August 1, 2018.

There is a growing body of research regarding the detrimental effects to an individual and to society relating to the collateral consequences of arrests and criminal convictions. To name just a few, a criminal history is a significant barrier to obtaining and advancing in a job, finding housing, and gaining additional skills or education. Inability to participate in society in these basic ways contributes to Delawares high rate of recidivism and lowers the overall productivity and efficiency of the State. An Act To Amend Title 10 Of The Delaware Code Relating To Release Of Persons Accused Of Crimes. [HB-470]
This Act would permit the Superior Court to conduct an evidentiary hearing, upon motion from the Department of Services for Children, Youth & Their Families, before placing a child 16 years of age or older, in a secure detention facility pending trial. An Act To Amend Title 10 Of The Delaware Code Relating To Juvenile Expungements. [HB-48]
This bill fixes a drafting error in Senate Bill 198 of the 148th General Assembly that inadvertently made it harder for juveniles to get mandatory expungements by adding the term violent misdemeanor as an excepting factor that would prevent a youth from receiving an expungement. Previously, violent misdemeanors were never included in the states statute regarding mandatory expungements. The bill also strikes the definition of violent misdemeanor, which is no longer applicable to the states juvenile expungement statute.The phrase sex offense was added (continued...)

An Act Proposing An Amendment To Article I Of The Delaware Constitution Relating To Equal Rights. [HB-5]
This Act is the first leg of an amendment to the Delaware Constitution to provide for equal rights. This amendment would advance human dignity and equality for all under the Delaware Constitution, and would correct a constitutional shortcoming. It subjects unequal treatment arising from historical bias to strict scrutiny, and enables courts in Delaware to establish jurisprudence concerning equal rights violations under State law reflecting Delaware values.

An Act To Amend The Delaware Code Relating To School Attendance. [HB-55]
This Act increases the age requirement for compulsory school attendance in Delaware from 16 to 18 years of age. The age increase is phased in over a two-year period; accordingly, there is a one-year interim period where the compulsory school attendance age requirement will be 17 years old.

An Act Concurring In A Proposed Amendment To Article Iv, Section 37 Of The Delaware Constitution Of 1897, As Amended, Relating To The Court On The Judiciary. [HB-56]
This Act is the second leg of a constitutional amendment that would add the Chief Magistrate to the Court on the Judiciary. Like all judges within the state, the judges of the Justice of the Peace Court are subject to the jurisdiction of the Court on the Judiciary. An Act To Amend Titles 10 And 14 Of The Delaware Code Relating To A Juvenile's Right To Counsel In Family Court And The Justice Of The Peace Court. [HB-6]
This Act codifies a juvenile's right to counsel in Family Court delinquency proceedings. The bill outlines certain circumstances where a juvenile may not waive the right to counsel: where the juvenile is accused of a felony, where the juvenile is in the custody of the Division of Family Services, where the juvenile is under the age of 16, or where the victim of the alleged delinquent act is a family member or guardian or where the family member or guardian has an interest adverse to the juvenile.

An Act To Amend Title 9 Of The Delaware Code Relating To The New Castle County Audit Committee. [HB-69]
This bill amends Title 9, Chapter 14 of the Delaware Code relating to New Castle County and the members of the Audit Committee, and provides that Audit Committee members' term of service is four years, instead of one year, provided, however, that the terms of any reconstituted committee shall be established in a staggered manner. This revision will lead to increased continuity, stability, and productivity of the Audit Committee.
