An Act To Amend Title 10 Of The Delaware Code Relating To Expungement. [HB-177]
This bill deals with the expungement of juvenile records of arrest and adjudications of delinquency and would become effective on January 1, 2012. Section 1015 sets out the procedure for filing an expungement petition and Section 1016 defines terms used in this subpart. Section 1017 sets out situations where the Family Court must grant an expungement petition: (1) Where a juvenile was charged with a misdemeanor and the charges were dismissed or not prosecuted or the child was acquitted and the child has no prior or subsequent adjudications/convictions

This Act is the product of the ‘Drug Law Revisions Committee.’ This Act repeals a significant portion of the existing criminal drug laws. In their place, this Act creates three main drug crimes – Drug Dealing (that is, delivery or manufacture, or possession with intent to deliver or manufacture); Aggravated Possession (that is, possession of amounts generally indicative of drug dealing but where drug dealing need not be proved); and Possession. An Act To Amend Title 7 Of The Delaware Code Relating To The Community Environmental Project Fund. [HB-197]
This Act provides that each civil or administrative penalty amount appropriated to the Community Environmental Project Fund will benefit the same community where the infraction or violation occurred that resulted in such penalty. A project benefits the same community if the project occurs within a 10-mile radius of where the infraction or violation occurred or if the Secretary of DNREC determines it is within the same community after consulting the Community Involvement Advisory Council.

An Act To Amend Title 14 Of The Delaware Code Relating To Charter Schools. [HB-205]
This legislation will assist the State to better ensure that charter schools being approved are of high quality, and to respond more appropriately when issues arise. To help ensure that individuals governing our charter schools have the appropriate background and qualifications, this legislation requires criminal background and child abuse registry checks for charter school board members, and it will prohibit individuals who have felony convictions or convictions for a crime against a child from serving on a charter board.
