An Act To Amend Title 21 Of The Delaware Code Relating To Habitual Offenders Status For Driving During A Period Of Suspension Or Revocation. [HB-68]
Under current law, if a person is arrested for driving with a suspended license and the judge finds that the sole reason for the suspension is that the person failed to pay a traffic ticket eligible for voluntary assessment, the lesser penalties for failure to reinstate apply in lieu of the penalties for driving during suspension. The General Assembly has further provided that a conviction for failure to reinstate obtained under such circumstances may not be considered for purposes of establishing habitual offender status. An Act To Amend Title 14 Of The Delaware Code Relating To Financial Assistance For Higher Education For Those Serving In The Delaware National Guard. [HB-73]
The Act makes several changes to the Delaware National Guard Educational Benefits program. Section 1 requires State-supported institutions to charge members the in-state rate for tuition and fees regardless of the members’ state of residence. Sections 2 and 3 make changes to allow members to pursue master’s degree programs. Section 4 allows members to receive a grade less than a 2.0 on an individual course, but requires members to maintain a cumulative grade point average of 2.0 or higher in order to receive reimbursement. An Act To Amend Chapter 10, Title 16 Of The Delaware Code Relating To Policies Of Hospitals And Other Facilities. [HB-75]
This Bill allows each competent adult patient to receive visits in a Hospital, nursing home or nursing facility from any individual from whom the patient desires to receive visits, subject to certain restrictions set forth in a visitation policy related to the patient’s medical condition, the number of visitors simultaneously permitted in a patient’s room, and visitation hours and/or order of a Court. In domestic violence situations, family pets are often a barrier to a victim of domestic violence from leaving an abusive relationship. The pet can even become a tool of violence for an abusive partner or parent/ guardian who is willing to injure or kill a pet as a retaliation or as part of a pre-emptive strike designed to gain or maintain control by means of terrorism. This Act clarifies existing law to make clear that the Court may grant, among other relief, that a Petitioner be given possession of a family pet via a protective order.
