This Bill constitutes a clarification of the effect of the consumer law changes in House Substitute 1 for House Bill No. 247, enacted in 2010. Several sections in Chapter 25 of Title 6 of the Delaware Code contained references to 2517 of Title 29, which was substantially modified by House Substitute 1 (moving the powers contained therein to several other sections). An Act To Amend Title 14 Of The Delaware Code Relating To School Attendance. [HB-244]
This Act increases the age requirement for compulsory school attendance in Delaware from 16 to 18 years of age. The age increase is phased in over a two-year period; accordingly, there is a one-year interim period where the compulsory school attendance age requirement will be 17 years old. The Act further provides that a child may be exempt from the age requirement for compulsory school attendance if the child has graduated from high school or if the child is at least 16 years old and is necessarily and lawfully employed. Furthermore, our legal system is increasingly placing children in much the same role as adults when it comes to trying and sentencing those children. This Act establishes a procedure for the evaluation of the competency of a child for the purpose of Family Court proceedings.
