C. 3122 implements requirements under the Individuals With Disabilities Education Act (“IDEA”) regarding the duty of school districts to locate, identify, and evaluate all children in need of special education and related services. The IDEA was amended to require that local school districts identify, locate, and evaluate all children who are in need of special education and related services and attending private schools at the election of their parents when the private schools being attended are located within the school district

An Act To Amend Title 16 Of The Delaware Code Relating To The Delaware Healthy Children Program. [SB-21]
This Act removes the provision requiring that participants in the Delaware Healthy Children Program pay a premium to participate, while allowing the Department of Health and Social Services to consider instituting minimal co-payments for health services in order to recover a portion of the revenue that would be lost due to the absence of premium payments. Removing the premium payment may reverse declining enrollment in the Program and increase the number of children in Delaware who have health insurance coverage.

An Act To Amend Title 21 Of The Delaware Code Relating To Helmets For Horseback Riders. [SB-225]
Head injuries are the most common cause of death for people who ride horses or ponies according to the American Medical Equestrian Association. This bill requires persons less than 18 years of age to wear a certified riding helmet. The law is written similarly to the mandatory bicycle helmet law. Several states have adopted such a requirement to encourage safe horseback riding for our youth. It is the intent of the Legislature to further promote the safety, health, and welfare of children younger than 18 years of age who engage in equestrian activities

An Act To Amend Titles 11 And 29 Of The Delaware Code Relating To Comprehensive School Safety Plans [SB-233]
Under existing laws and regulations, school districts are required to adopt an emergency preparedness plans, but there is no requirement that such plans be school-specific or coordinated with local first responders. In addition, while some plans are comprehensive, many emergency preparedness plans are not as detailed or up-to-date as they need to be. Under this bill – the Omnibus School Safety Act – the Department of Safety and Homeland Security (DSHS) will work with schools, districts and first responders to develop a comprehensive school safety

An Act To Amend Title 11 Of The Delaware Code Relating To Offenses Against Children. [SB-234]
This bill establishes the offense of Child Abuse. These new statutes combine current statutes and redefine physical injury and serious physical injury to reflect the medical realities of pain and impairment suffered by children. A new section provides special protection to infants, toddlers and children who have disabilities. The statute also expands the state of mind necessary for certain offenses against children allowing for more effective prosecution of parents who subject their children to abuse by others and fail to protect their children.
