This bill corrects technical errors to House Bill 177, passed in 2011 and dealing with juvenile expungement. Section 1 addresses confusion which has arisen regarding whether a Family Court judge may order expungement of charges arising in other counties. Sections 2, 3 and 4 address an accidental overlap in definitions of sex offenses in House Bill 177. The correction eliminates the overlap between misdemeanor and felony sex offenses and clarifies that a five-year wait applies before application may be made for discretionary expungement of a felony

An Act To Amend Title 5 Of The Delaware Code Relating To Loans. [HB-289]
This bill limits to five the number of short-term consumer loans (sometimes called payday loans) that any one borrower may obtain in a twelve month period. It changes the definition of short-term consumer loan to include loans up to $1000 rather than $500. The bill also provides for establishment of a database to track the number of short-term consumer loans an individual has obtained in a twelve month period. Finally, the Banking Commissioner is directed to provide a report on the prevalence and nature of these payday loans to the General Assembly.

An Act To Amend Title 21 Of The Delaware Code Relating To Motor Vehicles. [HB-293]
This bill allows an owner to have their motor vehicle title issued in transfer-on-death form by including in the certificate of title a designation of a beneficiary or beneficiaries so that, upon the owner’s death, the motor vehicle will be a non-probate asset that will pass to the beneficiary or beneficiaries named in the title.

This bill requires that a person who is operating a commercial motor vehicle in violation of the “electronic communication devices” law will have such violation made a part of their driving record. This Act fills a gap regarding the definition of “residence” in Delaware’s Sex Offender Registration and Notification Act (“SORNA”) that was recently identified by the decision of the Delaware Supreme Court in Andrews v. State. 34 A.3d 1061, 1064 (Del. 2011). Unlike many other jurisdictions, Delaware’s SORNA does not specifically define what would be considered a “residence” that must be registered. This bill significantly updates the laws under which a person can be held involuntarily for up to 24 hours for a mental health evaluation. An Act To Amend Title 14 Of The Delaware Code Relating To Kindergarten Readiness. [HB-317]
