This bill creates the Delaware Predatory Refund Anticipation Lending Prevention Act which prohibits unfair lending practices in relation to loans in advance of tax returns, and provides civil and administrative enforcement procedures. This bill would provide needed consumer protections for the Citizens of Delaware, and help to safeguard the economic vitality of our State.

An Act To Amend Title 29 Of The Delaware Code Relating To Transportation Of State Employees. [HB-305]
Current Federal regulations will not allow group home operators, funded by the Division of Developmental Disabilities Services (DDDS), to be billed by DDDS for use of Fleet Services vehicles. Federal regulations instead require that group home operators contract directly with Fleet Services. This statutory change will allow Delaware to continue to receive $1 million to $1.25 million a year in Federal funds to provide services to people with developmental disabilities.

An Act To Amend Title 18 Relating To Captive Insurance Companies. [HB-314]
This legislation amends chapter 69 of title 18 of the Delaware Code by adding two types of captive insurance companies to those that can currently be licensed in Delaware. The two new forms of captive insurance companies are “agency captive insurance companies” and “branch captive insurance companies.” Agency captive insurance companies are reinsurance companies owned by insurance agents or brokers who underwrite and place insurance policies for conventional insurance companies. This Act authorizes a sentencing court to modify, defer, reduce or suspend a minimum or mandatory sentence of one year of less if it finds the person to be sentenced has serious and ongoing medical treatment needs which make incarceration inappropriate and that the person does not pose a substantial risk to the community. The Department of Corrections has authority (11 Del. C. 4217) to request the modification of an inmate’s sentence based on medical illness or infirmity.
