An Act To Amend Title 7 Of The Delaware Code Relating To Environmental Control. [HB-355]
This Bill requires an expedited authorization process for the replacement or rebuilding of docks, piers, or bulkheads when they are being rebuilt on the existing or previously existing structural footprint. If the Secretary wrongfully denies such application the State shall be liable for the applicant’s reasonable attorney fees and expenses. The State’s immunity to liability is expressly waived.

An Act To Amend Title 29 Of The Delaware Code Relating To Limiting The Authority Of Public Bodies To Regulate Arms. [HB-357]
This new chapter is intended to address the banning of possession of firearms by certain governmental agencies and entities of the State. Currently, several housing agencies in this state have adopted policies of evicting or threatening to evict law abiding tenants from their homes merely for the otherwise lawful possession of firearms for self-defense. This practice constitutes discrimination based on economic circumstances leaving these residents at the mercy of criminals.

An Act To Amend Title 29 Of The Delaware Code Relating To Fiscal Projections. [HB-358]
This bill adds incoming revenue, if any, as part of a full-cost analysis of fiscal projections, often referred to as fiscal notes or F/N. Consideration would be given to the economic implications caused by action of the General Assembly in creating jobs and the revenue that might be generated, as well as predictable revenue calculated by contract or direct action.

An Act To Amend Titles 16 And 29 Of The Delaware Code Relating To Nursing Facilities And Similar Facilities. [HB-36]
This Bill clarifies the role of the Community Legal Aid Society, Inc. (CLASI), designated for the past 30 years as Delaware’s Protection and Advocacy Agency pursuant to federal law, in protecting patients and residents in nursing and similar facilities. As a complement to the existing protective system operated by the Department of Health and Social Services, CLASI is authorized to solicit and investigate reports of abuse, neglect, mistreatment and financial exploitation in covered facilities. This legislation designates the upper-level management positions in the Court of Common Pleas from classified service to exempt service, consistent with similar positions in the Superior Court and the Family Court. An Act To Amend Title 18 Of The Delaware Code Relating To Unfair Acts In The Business Of Insurance. [HB-367]
This bill requires an insurer who denies coverage for a procedure or test as medically unnecessary to reimburse an insured for all expenses, including out-of-pocket expenses, if the insured pays for the procedure or test and the procedure or test is proven to be medically necessary. Section 2307 of Title 18 contains the procedures to be used by the Insurance Commissioner when he or she has reason to believe that an insurer has engaged in an unfair practice, such as denying coverage as medically unnecessary.

An Act To Amend Title 21 Of The Delaware Code Relating To Motor Vehicles And Commercial Driver Licenses. [HB-368]
During a February 2009 Federal Motor Carrier Safety Administration (FMCSA) commercial driver license (CDL) program compliance review, Delaware was found out of compliance for lacking the specific statutory authority to impose certain federally regulated CDL program requirements. An Act To Amend Title 29 Of The Delaware Code Relating To The Freedom Of Information Act. [HB-369]
