An Act To Amend Titles 10 And 11 Of The Delaware Code Relating To Records Of Arrest And Prosecution. [HB-169]
This Act eliminates the five-year waiting period for a person who has successfully completed the Probation Before Judgment (“PBJ”) program, and the two-year waiting period for a person who has successfully completed the First Offenders Controlled Substances Diversion Program (“CSDP”), to obtain an expungement of the arrest and conviction records relating to that offense. This Act clarifies that offenses for which records have been expunged do not have to be disclosed as arrests. This Act also corrects for what appear to be inadvertent omissions

An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-176]
This bill increases the minimum fine for the first offense of Graffiti from “$500” to “$1000” and increases the hours of community service from “200” to “250”. The bill also increases the minimum fine for the second or subsequent offense of graffiti to “$2000” and increases the hours of community services to “500” hours.

This bill provides the Family Court with discretion to determine whether it is appropriate to designate juvenile offenders who are under age fourteen on the date of the offense or who were over age fourteen on the day of the offense but did not commit one of the offenses enumerated in 771-78 of Title 11 (for which registration is required pursuant to the federal Adam Walsh Act) as sex offenders, thus subjecting them to the registration and reporting requirements under Delaware law.
